The QBSA recently issued the following warning via a bulletin:
Do I need a licence to provide management or administration services?
Any contractor who carries out or undertakes to carry out building work in Queensland requires a BSA license. Carrying out building work isn’t limited to personally performing the work, or causing the work to be carried out. It includes management, administration or other services for building work.
Management services include services provided by a construction manager under a construction management contract, or a project manager under a project management agreement. A contractor also carries out building work if they coordinate the scheduling of work by trade contractors to construct a building or part of a building.
A contractor provides administration services for building work if they do any of the following:
Other building services requiring a BSA licence include advisory services (i.e. providing advice or a report about building work) and supervisory services.
Serious penalties apply to people who perform building work without holding an appropriate building licence. The maximum penalty for an individual is $18,750 and $93,750 for a company. Additionally, under the Queensland Building Services Authority Act, a contractor who provides building work services without a licence is not entitled to be paid for their services.
